1. MasterPlan

MasterPlan is a mobile app from Ziemann.IT Software, Plinganser Straße 19, 81369 Munich. MasterPlan offers customers (subscribers) the possibility to use their mobile device to quickly measure floor plans and other areas of rooms and to use the measured data to create cost estimates for craft work. The mobile app MasterPlan and the associated website (https://www.masterplan.app) are subject to the following terms of use, which are bindingly agreed between the customer (subscriber) and Ziemann.IT Software upon installation of the MasterPlan app or access to this website.

2. Prerequisites for the use of MasterPlan

Use of the app requires compatible devices with Internet access, which may result in additional fees. A list of compatible devices can be found at https://www.masterplan.app. Use may also depend on regular updates or the performance of the above factors. The fulfilment of the aforementioned requirements is the responsibility of the customer.

3. Subscription

(1) Only subscribers have access to the full functional range of the MasterPlan app. Users of the free app without a subscription receive limited access, in which some functions of the full version, such as data synchronization between different customer devices or the creation of an unlimited number of materials, projects and rooms, are not available. After purchasing a subscription, these functions are automatically activated.

(2) The purchase of a subscription is handled through the Apple App Store. This requires an Apple ID account. Payment will be charged to your Apple ID account at the confirmation of purchase. Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.

4. Privacy

5. Electronic communication

By using MasterPlan, customers can send automatically generated e-mails (cost estimates) electronically to their customers or prospects. Customers agree that both they and their customers or prospects will receive communication electronically. They further agree that such communication shall comply with all legal requirements for written form. Ziemann.IT Software is not responsible for input errors.

6. Copyright

(1) This website contains data and information of all kinds that are protected by trademark and/or copyright in favour of Ziemann.IT Software. It is therefore not permitted to download, reproduce or distribute the website in whole or in part. Above all, technical reproduction for browsing purposes is permitted, insofar as this action does not serve any commercial purposes, as is permanent reproduction for personal use. All content made available through the MasterPlan website is the sole property of Ziemann.IT Software and is protected by German and international copyright laws and database rights. It is permitted to set a link to this website as long as it serves only as a cross-reference. Ziemann.IT Software reserves the right to revoke the permission. Framing of this website is not permitted. The customers are not entitled to use the contents of this website beyond the use permitted in this granting of rights.

(2) The MasterPlan app and the information, graphics and functions it contains are protected by German and international copyright laws and database rights in favor of Ziemann.IT Software. Therefore, decompiling, disassembling or reverse engineering of the app or passing on the compiled software is not permitted. It is permitted to install the app on the Customer's mobile devices as well as to use the app for operational purposes for measuring areas or distances in rooms and to store this data in the structure provided for this purpose for the preparation of customer-specific cost estimates. The Customers are not entitled to use the MasterPlan app beyond the use permitted in this granting of rights.

7. Liability

(1) Ziemann.IT Software assumes liability for the contents of the app's website (https://www.masterplan.app) in accordance with the statutory provisions. Ziemann.IT Software assumes no liability for the correctness and completeness of the information contained on the website. References and links to third-party websites do not imply that Ziemann.IT Software adopts the content behind the reference or link as its own. The contents do not constitute any responsibility on the part of Ziemann.IT Software for the data and information provided there. Ziemann.IT Software has no influence on the content of these links. Ziemann.IT Software is therefore not liable for illegal, incorrect or incomplete content or for damage caused by the use of content behind the link. Use of the Internet is at the customer's own risk. In particular, Ziemann.IT Software shall not be liable for any technical failure of the Internet or access to the Internet.

(2) Ziemann.IT Software assumes liability for the app in accordance with the statutory provisions. However, use of the MasterPlan app is at the Customer's own risk. Therefore, Ziemann.IT Software shall not be liable for damages resulting from incorrect entries by the Customer or the use of the app under conditions that impair its correct functioning.

8. Applicable law and place of jurisdiction

German law shall apply to the exclusion of the uniform international sales law (CISG). Exclusive place of performance for contractual obligations is the registered office of Ziemann.IT Software (Munich).

9. Severability clause

Ziemann.IT Software reserves the right to modify these Terms of Use from time to time and to adapt them to technical and legal developments. The customers will be informed of the changes separately. In the event of the invalidity of individual provisions of these Terms of Use, the validity of the remaining provisions shall remain unaffected.
